Almost every piece of software sold has a "shrink wrap" statement to that effect, but that does not make it a fact. Since these shrink wrap agreements are not valid, plus the fact that these are commodities which are sold in stores across the land, plus the fact that most states charge a sales tax, plus the fact that virtually every consummer believes that they have purchased the copy of the software that they paid for means to me that such electronic materials are not licensed, but are sold.
In other words, if every magazine and book had a similar statement on their title pages, it would NOT in the least alter the way those books and magazines were viewed viz a viz copyright.
