The case I recall is the Franklin Mint case where
an artist painted a cardinal sitting on a branch of
an apple tree. He then repainted very similar or
identical works. Its citation is:
Franklin Mint v. National Wildlife Art Exchange, 575 F2d 64 (3d Cir. 1978).
