See Sept. 15 CHRONICLE OF HIGHER EDUCATION pg. A32. "Education Dept. Backs off Statement That Colleges Need Permission to Keep Student Theses in Libraries" by Scott Jaschik. Reports that Leroy s. Hooker (Ed. Dept. compliance guy) says that while theses are "clearly student records," they "differ in nature from typical student research papers and other education records..." Basically he said that permission did not need to be sought, but that students must be told, in advance, that their papers would be made available.
