I believe the situation you describe of a faculty member making excerpts of a videotape for a class is covered under sec. 110 if the edited copy then becomes the only copy of the tape. The editing and showing to a class is permitted by sec. 110, the making of a reproduction probably is not.
What about just seeking permission? Or just purchasing a second copy so that you can have one in full glory and` the "using up the second copy" to make the edited version. Of course, it is physically possible to retain all three, but the holder has not lost royalties by the alternative I suggested.
