Thanks to everyone for all of the input on this. We do have University council working on it, I was just looking for some pointers for the programmers while the higher-ups were hashing it out, and I think we got them. We actually have two separate chunks of code that are in dispute, and the responses made it fairly clear that the ex-employee has a strong case for one and a very marginal case in the second. It was the second that we were more worried about in this instance, since he was trying to claim the same kinds of rights with respect to it as we had granted him for the original chunk of code, so we're just going to expend less effort trying to accomodate him until we hear that we have to.
