As a photographer from the past (I'm not a pro in that field now) I'd say yes. I have seen photos of famous pictures (I think it was an Irving Penn) with a pen or specs lying on the photo allowable. And that was not even a publicaly displayed thing.
I'd say it was just to photograph anything in a public place - after all you can photograph a person in the street and put their face in a postcard for Picadilly Circus and sell it - as a photojournalist I would fight for that right....if I had to :-)
