I have not read Ruth Dukelow's book, so I cannot comment on any
part of it. But her recent message implies that the limits of
fair use photocopying are defined by the "official" guidelines
that appeared in the 1976 congressional report. Most readers
here may be aware of the strict quantitative nature of those
guidelines (counting words, authors, etc.). One may choose to
follow those guidelines if a conservative "safe harbor" is what
you desire. We must acknowledge, however, that they are
explicitly "minimum" standards of fair use, that they are not
(not!) the law, and that other opportunities and rights of fair
use exist beyond the scope of those meticulous standards.
