Maryly Snow reported the unfavorable comments of the UCBerkeley law
librarian on the Hearn v. Meyer case.
I'm extremely happy to hear that Hearn v. Meyer has been criticized, since I considered it a pretty awful result. I'd be happy to learn the results of your research into cases that have lambasted it.
Even though it was *only* a district court case and *only* in New York, decisions of the Southern District of NY are normally widely respected, especially in areas in which New York is the leading commercial center, among which is publishing.
You might consider "Shepardizing" the case to see if reaction of other courts to Hearn v. Meyer has been as universally negative as the librarian suggests.
