A similar situation has occured here in the UK. Many publications
(hard copy) contain strictures against any copying -my understanding
is that these are meaningless and intimidatory, ie. fair use
provisions override. Further -in the UK the fair use limits on
copying portions of books are ill-defined ("reasonable/substantial");
the publishers have deemed this to mean 5% or 1 chapter and this has
been accepted/propogated by certain professional bodies although no
case law has decided the issue! It seems that publishers are now
trying to create the law.
