The text of 17 USC 1008 (part of the Audio Home Recording Act) in the Supplement to the 4th edition (p. 155) omits the word "such" before "a device or medium" in the second to last line. It should read
"consumer of such a device or medium . . ."
I relied on the absence of the word "such" in crafting a theory
-- thank God, not in a real case -- and ended up with egg on my face.
Be warned.
The word "such" appears in both the LEXIS and the WESTLAW versions of the statute.
