Scott, what makes you believe that the performance right would be exercised by performers, rather than the record companies that contractually own the rights to administer to the recording on behalf of performers? It is not U.S. govt practice to override contracts in that manner, and it would cause another anomaly with respect to rights in motion pictures vis a vis actors and actresses.
