IMHO, clearly the former. My understanding, BTW, is that the software publishers claim that even garden variety returns of software (without any special program like the above to promote it) are illegal rentals/lendings, although some have abandoned that position and now offer an explicit "satisfaction guarantee" as a marketing tool.
