Question. If a photograph of a public domain painting obtains protection under the copyright laws does this also apply to a digital camera photo?

If this is the case then it seems to me that since the technology is the same that when you scan a public domain book (ie take a digital picture) the same rights would accrue.

In this case might not the OCR of such a "protected" work be judged a derivitive work?
