A photograph of a public domain painting, whether taken with a "regular" camera, or a digital camera still requires that ambiguous test of a "Modicrum of creativity" to aquire those rights embodied within a copyright. Your comment as to whether the photo constitutes a derivative work would apply to a work that was still protected by a copyright, and not in the public domain.
