In Brazil, we have a system of implied licenses and licenses given to the rental shops to stock and rent video tapes. I may be wrong, but I think the system works like this here. I believe that, when the rental store buys the tapes from teh distributors for rental purposes, there is some sort of licensing agreement envolved.
I remember also that some rental shops make deals with the distributors, in which they buy the use of the tape for a couple of months. The shop I rent my videos at is a major chain, and I knew that somehow they had like 15 copies of "pulp fiction" in the release date, and I asked the manager If, two months from now, i would be able to see the film without getting in a wait list... there would be 15 copies, right??... Well, he told me that probably 12 will be sent back to their headquarters as soon as teh "renting buzz" ceases. Sounds unusual... maybe they have an unusual agreement involved.
And here in brazil, you can rent CD-ROMs and music CD's... It is not a big business, but a very profitable one. And, in this one, I know they do not have any sort of license to do so. I know the owner of a CD rental shop and he has been threatened by the record companies to quit this business before they get the police and the law involved.
