An interesting situation came up for the Boston chapter of the National Writers Union (of which I'm a member). We're putting together a fundraising booklet that will include published articles by a dozen members. In cases where the writer owned copyright, our steering committee decided not to use photocopies of the text from the magazines for fear of infringement, and instead asked contributors to send their articles as ASCII text.
This raises the question of how UnCover, which sells faxed article reprints -- and which has agreed to pay writers for their use -- can do so without getting permission from and presumably making payment to the publisher as well as to the writer.
Any comments?
