Shrinkwraps in Europe

Hello,

I am researching the enforceability of "shrinkwrap" licenses in Europe, especially the EEC. I have the Directive on the legal protection of computer programs (91/250/EEC) and I have read several papers on the subject that are several years old.

How have the individual member countries adapted their laws to meet the requirements of the Directive? Is there any case law? Surely someone in Europe by now has infringed on a shrinkwrap??

I've noticed several terms that all correspond to this type of license: shrinkwrap, box-top, tear-open, blisterwrap. Are there any others I should be on the look-out for? What are the French and Spanish terms for this (these are the only other languages I even have a chance of being able to read, although I doubt I could get through any legal writings:).

Dare I add this disclaimer: I am not asking anyone to do the work for me. I am looking for people who have expertise and are willing to share their knowledge of existing European statutory and case law.

Thanks,
Gerry
