MDS Decision Vacated

On April 9, the Sixth Circuit vacated the panel's decision favoring MDS and granted rehearing en banc, setting a briefing schedule for rehearing of MDS's appeal before the full court. The effect is to reinstate the district court's injunction, and render the panel's decision null and void. Very few decisions are reheard by the full court, and the majority of those reheard reach a result opposite to the panel decision being vacated.
