I would like to think that pleadings enter the public domain through the process of filing. As it is, pleadings are often quoted. Fair use. Perhaps there is a gray area, in that pleadings quoted should certainly be acknowledged. However, I believe that fair use should be expanded.
With regard to forms of pleadings, perhaps that could be analogized to blank forms- unprotectable.
