Indeed! The "test" as it were, is whether the "form" in itself conveys information. If so, it is likely copyrightable. If not, it is likely not copyrightable. To the extent that most "form" contracts convey information I agree with you. My reference to Baker v. Selden was aimed at a misinterpretation that ALL forms are copyrightable, which they are not.
