I can't give you the US legal answer, but this being an internet forum there might be interest in the solutions of other countries and I can reply from the view of German law.The German Federal Civil Court(Bundesgerichtshof) ruled on 17.April 1986 (I Z 213/83 ) that lawyers briefs are covered by the lawyers copyright if the brief steps over a (low) threshhold of creativity,i.e. practically always.
