You might want to read an article of mine entitled appropriately enough "Fair Use." Click on "Helpful Articles for Writers and Publishers" on my site.

This is a very open area that depends on ad hoc, case by case factual material. Fair use is also a defense to a copyright infringement action, raised by parties that have not obtained a license to use the material. When in doubt, get a license!
