UNPUBLISHED WORKS

I have a question based upon a recent request for permission:

Are masters theses manuscripts written prior to 1978 considered published or unpublished once they are placed in the University's libraries and accessible by the public?

If they are considered unpublished, would permission be required to reprint unpublished theses in another publication (assuming fair use does not apply) under the 1909 Act?
