If that is indeed the case, then I concur that Disney has at least satisfied that prong of the trademark test as to the current Mickey. I still don't know that the protection would extend to the old Mickey image unless that old image was similarly used. I do not have those facts, so I cannot complete the analysis. Perhaps someone who can tell us about actual use of the old Mickey image can fill in the gap.
