page construction and copyright

I am on this list because I am on a copyright committee here and up to this point have mostly lurked, but I have a couple of questions today.

I read an article in a journal about learning html by using the edit capability of Netscape. A faculty member brought this to my attention by a faculty member. Here is a paraphrase of the relevant sentences; Do not worry about copyright violations. The faculty member was concerned because he wants students to conform to the law and he considered the article to advocate something against the law. I agree with him, but would like to know how you on this list view such advice in a widely read journal.

I have another question for you which was brought up to me by the same faculty member; is it a violation of the copyright or tradmark law to put up a web cite of some trademarked and copyrighted material without material, eg. Star Wars material. I understand that Bill Gates brought a suit concerning such a thing, but dropped it. TIA.
