The solution I've often seen is the present grant of a right of first refusal in the event of a re-offer of the work after the exercise of the statutory right of termination.

Section 203 (a) (5) says that "[t]ermination of the grant may be effected notwithstanding any agreement to the contrary." You can try to contract around that, but the Judge is sworn to uphold the law. The "grant" referred to concerns a transfer or license made on or after 1/1/78, so you couldn't "test" such a clause until at least the year 2013.
