I think overhauling the "copyright system" would be a bit of an overreaction--and possibly Kafkaesque in itself. Maybe we just need some definitive opinion as to what copyright protects and what it doesn't with respect to email. Until we get it, those who can't live with implied license should put an express license on their emails.
