Tim,

For one thing just try typing

  http://www.altavista.com/

into your web browser. Unless they've changed it again the graphics look very much like the altavista.digital.com web site and a search form is provided.

I'm not sure about the lawsuit, but I've been thrown once or twice myself when I wasn't thinking carefully enough about where altavista was located.
