I believe you are looking for the decision of the U.S. District Court for the District of Massachusetts, dated March 12, 1997. This case involves a dispute between Digital Equipment Corporation and Alta Vista Technology, Inc. over rights and commercial interests on the Internet. DEC owns the search engine known as Alta Vista. Digital purchased ATI's rights in its trademark "Alta Vista" then licensed back to ATI a right of use in limited ways. In the instant action, DEC brought suit against Alta Vista Technology, Inc. for breach of trademark licensing agreement, trademark and servicemark infringement, unfair competition and trademark dilution. This decision is scheduled to be discussed in our newsletter #189 of the Guide to Computer Law. The decision is to be printed in its entirety in the supplemental pages which will accompany the newsletter mailing.
