I think that's the nub of the argument.
Who's talking about copying? I don't understand my argument to be about copying. If TotalNews is _displaying_ my work without my permission, it is a violation of my absolute right to control the display or performance of my work. Copying doesn't enter into my argument. Sorry I wasn't clear on that.
You can perform a copyrighted play without every having made a copy of the script. The actors memorize their lines from watching the movie, then you sell tickets, and you do the performance on stage. No copies are made. The public performance of the play is a violation of the playwright's copyright (assuming it exists). Display and performance are a part of the act, along with copies.
