Here's an idea for you all to tear apart. Since arbitration clauses (even shrink wrap) are generally enforceable, and since online copyright infringement will increasingly involve participants who do not reside in the same nation, why not promote the use of arbitration clauses in online use contracts, with a specification that disputes be resolved in a forum specifically designed for that purpose (analogous to the WIPO Arbitration Centre)? (EDR, anyone?)
