My understanding, according to the news releases, is that Tahini et al. intended to move for reconsideration by the same judge, on the ground that she misapprehended some of the facts. Basically, they have to do so to preserve those factual issues for appeal. I do not recall all of the details.

A motion for reconsideration under Rule 59 is, indeed, very quiet--it ordinarily involves just another round of briefing by both sides.
