Dear Friends:
The public domain is filled with images of master artists of ages past. For example, paintings of Martin Luther, Henry VIII, etc. exist, giving us some idea of what these historic figures looked like. The painters who produced these portraits have been gone for some time now, so their works are in the public domain.
Now, should someone photograph such a work, where the work itself is the only subject, where no changes are made in composition, say, by putting Pres. Clinton in front of one, where there would be no eye level way of telling it from another photograph of the same image, would the resulting image be in the public domain?
