On March 27 Darren Donnelly mentioned the influence of Justice Story on the development of copyright law. Prof. Kaplan discusses this, if I remember correctly, in some depth in one of his lectures in "An Unhurried View of Copyright." For those interested in forming their own judgments, a review of Emerson v. Davies, 8 F. Cas. 615 (C.C.D. Mass. 1845), is a must. It is remarkable how many seeds of modern copyright doctrine were planted in that case, which involved the alleged copying of a series of arithmetic lessons.
