Two issues in Feist were: the lack of originality in the selection and arrangement of the contents, and the fact that the company was required to make such a listing as condition of doing business. Any creativity in the selection and arrangement of the underlying data in a database would probably protect from wholesale extraction, especially if the extraction was used to create a competing commercial product.
