I think the Second Circuit's decision in NBA v. Motorola 105 F.3d 841 (2nd Cir. 1997) held that there remains a little margin for misappropriation law. The Motorola court held that state misappropriation law was not pre-empted if it met 5 conditions, one of which was that the information be "time-sensitive".
