I am not a professional educator, but I think there are several points that need clarification:

  1. If the material is public domain (e.g. Shakespeare) and not edited or annotated (which is often, one suspects, done entirely so as to create copyrightability) then it should be fair game, except for additions (e.g.., forewords, commentaries).
  2. If the material is not public domain, perhaps the publishers could authorize such copying so as to facilitate sales and beef up their profits. Ever notice how many books are out of print? Want to guess why? There's no money in it!
