In the House report of HR 2652, it states that while the act's protection does not extend to govt. agencies or their exclusive licensees it does protect the licensees if they have added value to the database. (pg's 16 and 17 of the House report).
In the case of HyperLaw v. West Publishing, the judge said that the little touches that West adds to its published versions of the opinions were not enough to count as adding value. The case is now pending appeal.
It appears that this legislation would halt the litigation in its tracks and overturn it.
