Provided there is a modicum of creativity. A phone book does not qualify, for example. An alphabetized list of students in a class probably does not qualify. There is no minimum age requirement.
Just because something is copyrighted does not mean that it cannot be copied. Fair use is a doctrine of the Copyright laws that allows for copying when conditions are met. One also licenses others to copy by the circumstances of one's acts. For example, when you send a letter to the editor of a newspaper, one issues an implied license to the editor to print your letter in that newspaper.
