Concerning Mr. Riolo's hypothetical: I must agree with the other commentators that re-assembling a torn page no more creates an original work than re-assembling a jigsaw puzzle creates a new photograph.
Even in the case of complex reconstructions, I whould hold the scholars to their claims about their work. A scholar who claimed he had reconstructed the original would be denied copyright, since by definition the result of his efforts is a readable edition of SOMEONE ELSE's work, not his own.
