  This happens all the time in "work for hire" cases, where the true author is in dispute. Both will register the work, and let the courts settle the matter. The Copyright office will not refuse to register when they know that the exact same work has already been registered, they will issue another registration. They do not operate like the Patent office or the Trademark office (both are in the PTO), where an examination is made and a comparison is made to see if the content is eligible for protection. The Copyright office merely checks to see if the subject matter is eligible for protection...
