        You skipped over my all time favorite from these cases, Judge Whyte's opinion in the Henson case that it is *not* fair use to submit the entire text of a document <NOTS-34> to the FDA to document the unlicensed practice of medicine with unapproved devices <E-Meter> by the Church of Scientology. In fairness to Judge Whyte, the opinion may have been an implication that the document in fact did not support the thesis.

        My personal opinion is that the FDA should have made that determination.
