I was going to stay out of this lest my ignorance show, but I believe one common use, and part of the case law supporting EULAs is the disclaimers frequently found on travel documents such as airline tickets and cruise ship agreements. It was a cruise line case which, AFAIK, established the legitimacy of such agreements.
Many authorities still question the enforceability of software EULAs, including Nimmer and Samuelson (not sure if she's an authority, but I'll throw her in anyhow).
