The Eleventh Amendment applies only to States.
An entirely different scheme exists with respect to the federal government.
A suit may be brought against the United States for copyright infringement in Claims Court. While one may not enjoin the US, one may possibly recover "reasonable compensation" for the use of the copyrighted material.
