At the time a broadcast, or a recording, was not considered publication and (as I understand it) could not be copyrighted. The script could. If the script was not copyrighted and not published, then it would remain an unpublished work (apparently--comments welcome from those who have legal experience with such things), and thus protected to the extent that an unpublished work was/is protected.
