Suppose I go to hear Rodney Dangerfield live and take down all his jokes (not by phono recording, but by writing). I then go out and publish this as a joke book, without attribution or permission. Is "telling" a joke an act of publishing? Or is the joke (which presumably was written down by Mr Rodney somewhere) protected as an unpublished work?
