Sampling (of audio recordings)

I have undertaken research regarding legal issues with respect to sampling of audio recordings. I would greatly appreciate referrals to articles/other literature (preferably by lawyers and legal scholars where the articles discuss legal issues) or common law jurisdiction case-law regarding the following topics:

• Current licensing practices with respect to the sampling of commercially released audio recordings (assuming the samples are to be used in recordings that will be commercially released),
• Fair Use as a defence to sampling (again, in a commercial context),
• Claim of Moral Rights infringement to prohibit use of otherwise validly licensed samples,
• Economic theory/implications of allowing/prohibiting sampling (esp. regarding incentive to create), and
• any other literature related to sampling of audio recordings.
