Both Miller and Bowen anti-spam bills wre signed. I think between the filtering-enabling requirements and the opt-out we may start seeing some relief on this. I think stronger measures may have easily been found unconstitutional, so moving forward slowly is a good idea. Certainly if this doesn't work then under the constitutional analysis stronger provisions would be justified.
