NO, certainly not in the absence of federal legislation. This is well established. The federal fax legislation was preceded by a host of state laws, as was the federal telemarketers legislation. In the case of interstate calls federal legislation is necessary though because of federal laws prohibiting the states from regulating interstate phone calls.
