Marvin E Frankel

I am situated in South Africa. I need to get copyright on a article written by Judge Marvin E. Frankel in 1975. The author retained copyright on the article.

My problem is that it is very difficult for me to get more details on the author like address, etc. I have already received permission from the journal in which the article was printed but cannot trace the author. Can anybody tell me what the United States Copyright law suggests in such a case?
